Obamacare arm twisting

Here comes the arm twisting branch of the government. The Justice Department has asked a federal judge in Florida to tell states that they must continue to enact the Obama administration’s health care overhaul despite the judge’s ruling that the law is unconstitutional. The way they through a motion to clarify, administration attorneys asked U.S. District Judge Roger Vinson to make clear that states cannot ignore the new health care laws while his ruling is being appealed. This is going to be a big play between executive and judicial branch. We get the feeling this will not be decided on the floor but a backroom as the administration is going to come a calling with a golden nugget for Judge Vinson, an offer you cannot refuse so to speak. The government is concerned over 2011 changes in Medicare payment rates. Florida and 25 other states filed the lawsuit that said Congress exceeded its authority by requiring all citizens to purchase health insurance or face tax penalties. This of course was amped up when Alaska Governor Sean Parnell said he would not implement the new law because Vinson ruled it was unconstitutional. Vinson clearly stated that the order equaled an injunction which legally halts or forbids something. We hope this is going to fast track this to the Supreme Court as now President Obama played a card and the need is there to make this come down to the Supreme Court. This is no slam dunk either but if any branch can put the brakes on Obamacare it is them.
